My wife had another car mishap today, and by the time I arrived, the tension was through the roof. When the police showed up, she was absolutely riled up, pacing back and forth and insisting to anyone who would listen that the man she hit was being completely reckless.
She didn’t hold back, either. “He was on his phone!” she fumed, pointing an accusing finger at the other driver. Then, for the grand finale, she turned to the officer and added, “And to top it off, he was just sitting there, drinking a beer!”
The officer paused, pen hovering over his notepad, and looked from the wreckage to the other driver. There was a long, heavy silence as the reality of the “accident” started to settle in. Because, as it turns out, there is a very specific legal distinction between hitting a car that is moving and hitting one that is… well, let’s just say, parked.
